When an employer lost access to its rented premises it forced an employee to take annual leave. Eventually, it terminated his employment when the dispute with the landlord resulted in it ceasing to trade at those premises. The Fair Work Commission held that the matter should have been treated as a redundancy. Still, because the employer did not follow the processes required for redundancies, the employee was unfairly dismissed.
